ThinkHaus Spaces Private Limited (“ThinkHaus”, “we”, “us” or “our”) owns and operates the website at https://www.thinkhaus.in (the “Site”). These Website Terms of Service (“Website Terms”) set out the rights and obligations of every visitor or user of the Site (“you” or “user”).
By accessing, browsing or using the Site, submitting an enquiry, scheduling a tour or making a booking through the Site, you agree to these Website Terms and our Privacy Policy. If you do not agree, you must not use the Site.
Important scope note
These Website Terms govern the Site and website-based enquiries or bookings. Use of a physical ThinkHaus workspace, a membership, managed-office arrangement, event package or another service may also be governed by separate booking terms, house rules, an order form or a signed agreement. If those specific terms conflict with these Website Terms, the specific terms will govern the relevant service.
The Site provides information about ThinkHaus workspaces and may allow users to submit enquiries, schedule tours, request proposals or book selected services such as day passes, meeting rooms, board rooms, podcast studios or events.
If you access restricted services requiring a login, use a ThinkHaus location, participate in a referral or broker programme, or purchase a membership or managed workspace, additional terms may apply. If you book through a third-party platform, that platform’s terms may also apply.
We may modify the Site or these Website Terms from time to time. The revised terms will be posted on the Site with an updated date. Your continued use after the revised terms are posted constitutes acceptance of those changes, except where applicable law requires a different form of notice or consent.
The Site and the services described on it are intended for individuals who are at least 18 years old and legally capable of entering into a binding contract. By using the Site, you represent that you meet these requirements.
If you use the Site or make a booking on behalf of a company, partnership or other organisation, you represent that you have authority to bind that organisation. In that case, “you” includes both you and the organisation.
Subject to these Website Terms, ThinkHaus grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable right to access and use the Site for lawful personal or internal business purposes.
You must not:
The Site and all text, photographs, graphics, layouts, logos, trade names, videos, audio, software, designs and other materials made available through it (collectively, “Content”) are owned by or licensed to ThinkHaus and are protected by Indian and international intellectual-property laws.
Except for the limited right to view and use the Site under these Website Terms, no licence, ownership right or other interest in the Site, Content, ThinkHaus name, trademarks or branding is granted to you. You may not modify, publish, transmit, reproduce, distribute, display, create derivative works from or commercially exploit any Content without our prior written permission.
Content is provided for general information and may not describe every feature, price, availability or condition of a service. We may update, correct, remove or change Content at any time without notice.
You are responsible for ensuring that information submitted through the Site is complete, current and accurate. Submission of an enquiry, tour request or proposal request does not create a confirmed booking or require ThinkHaus to provide a service.
A tour is confirmed only when ThinkHaus sends a confirmation. Tours are subject to availability, site access requirements and reasonable rescheduling or cancellation by either party. Unless expressly stated, tour requests are free of charge.
A paid booking is confirmed only after successful payment, any required identity or KYC verification, and a confirmation issued by ThinkHaus or its authorised booking partner.
The service description, location, date, time, capacity, inclusions, price, taxes and any product-specific conditions displayed during booking or in the confirmation form part of your agreement. You must review those details carefully before confirming payment.
You are responsible for complying with applicable house rules, safety and security requirements, access procedures, acceptable-use rules and reasonable instructions from ThinkHaus personnel. A booking may not be transferred or resold without our prior written approval.
Prices are displayed in Indian Rupees unless stated otherwise. Applicable taxes, convenience fees or other charges will be shown before payment where required. You authorise ThinkHaus and its payment providers to charge the payment method selected by you for the total amount shown.
Payment processing may be provided by a third party. ThinkHaus does not ordinarily receive or store full card credentials. A payment is not complete until it is successfully authorised and received. You remain responsible for bank charges, failed-payment fees or taxes payable by you.
We may correct an obvious pricing or description error before service delivery. If a confirmed booking is affected, we will offer the corrected booking or cancel it and refund the amount received for that booking
ThinkHaus may require identity verification, government-issued identification, company information or other Know Your Customer (KYC) documentation before granting access or providing a service. The nature of verification may vary by service, booking value, duration, user type, location or legal requirement.
You must provide genuine, complete and valid information within the time specified. ThinkHaus may withhold confirmation, deny access or cancel a request where verification is incomplete, unsuccessful or raises a reasonable security, fraud or compliance concern.
Payments are generally non-refundable.
Except where required by applicable law, expressly stated in the booking flow, agreed by ThinkHaus in writing, or provided under Section 11 below, payments are irrevocable, non-refundable and non-creditable. Failure to attend, late arrival, early departure, failure to meet access requirements or failure to complete required KYC does not entitle the customer to a refund.
Nothing in these Website Terms excludes or limits a refund, remedy or other right that cannot lawfully be excluded under the Consumer Protection Act, 2019 or another applicable law.
Day passes and other on-demand workspace bookings made through the Site cannot be cancelled for a refund. If a rescheduling option is offered through the Site or confirmed by ThinkHaus, rescheduling is subject to availability and the conditions displayed at booking or communicated by ThinkHaus.
Confirmed meeting-room, board-room and podcast-studio bookings cannot be cancelled for a refund. Any rescheduling permitted by ThinkHaus is subject to availability, operating hours, capacity, advance-notice requirements and any price difference.
Confirmed event bookings cannot be cancelled for a refund unless the applicable event proposal or signed agreement expressly provides otherwise. Event-specific terms, including deposits, minimum commitments, vendor requirements, damage charges and rescheduling, will prevail over this subsection.
You may request cancellation or rescheduling of a tour before its scheduled time. A revised slot is subject to availability. Repeated no-shows or misuse of tour bookings may result in future requests being declined.
ThinkHaus may reasonably change a workspace, room, time or service where necessary because of maintenance, safety, operational requirements, building restrictions, an emergency or circumstances beyond our reasonable control. We will endeavour to provide reasonable notice where practicable.
If ThinkHaus cannot honour a confirmed paid booking and does not provide a reasonably comparable alternative accepted by you, our responsibility will be limited to refunding the amount received for the affected booking, subject to rights that cannot be excluded under applicable law.
The Site may contain links to or integrations with payment providers, maps, social networks, booking partners or other third-party services. ThinkHaus does not control and is not responsible for their content, availability, security, terms or privacy practices.
If you book or purchase through a third party, that party’s terms may apply in addition to the relevant ThinkHaus terms. To the maximum extent permitted by law, ThinkHaus is not liable for claims, losses or expenses arising from a third party’s independent acts, omissions, products or services.
Our collection and use of Personal Data are described in the ThinkHaus Privacy Policy available on the Site. By providing contact details, you agree to receive transactional communications relating to enquiries, tours, bookings, payments, access, safety and service updates. Marketing communications will be sent only as permitted by law, and you may opt out using the method provided.
To the maximum extent permitted by law, the Site and Content are provided on an “as is” and “as available” basis. ThinkHaus and its directors, officers, employees, agents, contractors, successors and permitted assigns (collectively, the “ThinkHaus Parties”) disclaim warranties and conditions, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability and freedom from harmful components.
ThinkHaus does not warrant that every workspace, service, price, photograph, amenity or availability shown on the Site will remain unchanged. Photographs and layouts may be illustrative, and actual configuration or finishes may vary. Nothing on the Site constitutes legal, tax, financial, medical or professional advice.
To the maximum extent permitted by law, the aggregate liability of the ThinkHaus Parties arising out of or relating to the Site will not exceed INR 10,000. This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation.
ThinkHaus may restrict, suspend or terminate access to the Site, cancel an unconfirmed request or refuse a booking if we reasonably believe that you have breached these Website Terms, engaged in fraud or misuse, created a security or safety risk, or used the Site unlawfully. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limitations and governing law—will survive.
These Website Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory rights or jurisdiction available under applicable consumer law, courts at New Delhi, India will have exclusive jurisdiction over disputes arising from or relating to the Site or these Website Terms.
Before commencing proceedings, you and ThinkHaus should attempt in good faith to resolve the dispute by written notice and discussion for at least 30 days, unless urgent interim relief is reasonably required.
Entire agreement. These Website Terms, the Privacy Policy and any terms incorporated by reference constitute the entire agreement regarding use of the Site and supersede prior communications on that subject.
Severability. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
No waiver. A failure or delay in enforcing a right is not a waiver. A waiver by ThinkHaus must be in writing and applies only to the specific instance for which it is given.
Assignment. You may not assign or transfer your rights or obligations under these Website Terms without our prior written consent. ThinkHaus may assign them as part of a merger, restructuring, sale of business or assets, or to an affiliate or successor.
Headings. Headings are for convenience only and do not affect interpretation.
Electronic records. You agree that electronic acceptances, confirmations, notices and records may be used in connection with the Site and will have the effect permitted by applicable law.
